Which Agency and Regulations Apply to Your Work?

Depending upon the type of research or other work that you are doing, more than one agency and body of regulation could have something to say about how you pursue it, and that probably isn’t limited just to the export control/sanction program world.  After looking at the descriptions of the agencies below, you will note that it is typically the subject matter with which you are working that invokes the jurisdiction of a particular agency and its regulations; but determining how much or little you need to do to comply with those regulations typically depends upon additional factors, such as: foreign countries involved, the background of recipients of project subject matter, and how we expect recipients to use tangible items and information.

Department of Defense

The U.S. Department of Defense can both directly and indirectly have an impact upon how we perform our work.  For example, they can require that certain clauses from the Defense Federal Acquisition Regulation Supplement (DFARS) be included in our research contracts, with such clauses placing restrictions upon how we may share tangible items and information with foreign persons.  Or, they may be consulted by other agencies that have their own export control regulations, such as the U.S. Department of State.  By following the link below, you will be able to appreciate the possible impacts that this U.S. agency may have upon your work.  This will be especially valuable for those of you who expect to work as a prime or subcontractor recipients of funding from a Dept. of Defense contracting office.
